Terms of Service.

By creating a TextLaunched account or using the TextLaunched product, you agree to these Terms of Service. If you do not agree, do not use the service. TextLaunched is operated by Talented Network LLC ("we", "us"). The product is licensed, not sold.

TextLaunched is an AI marketing manager you operate by texting a dedicated phone number. The AI generates campaign drafts, audience segments, and recommendations grounded in the data you connect (Shopify, Klaviyo, Mailchimp). You approve drafts via SMS reply or in the dashboard. The AI does not send campaigns autonomously unless you explicitly enable Auto mode and the campaign clears the eval composite score floor you set.

Plans and pricing are listed at /pricing. Subscriptions are billed monthly in advance via Stripe. You can cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period. We do not issue refunds for partial months. Free tier accounts have no payment obligation.

The AI marketing manager workflow uses SMS as a primary interface. By providing your phone number you consent to receive SMS messages from TextLaunched related to your account and active campaigns. Reply STOP to unsubscribe; HELP for help. Message frequency varies; message and data rates may apply per your carrier plan. Full SMS terms are in the Privacy Policy section 4.

You are responsible for the campaigns you approve and ship through TextLaunched. You agree to comply with all applicable laws governing email and SMS marketing in your jurisdiction (CAN-SPAM, TCPA, GDPR, CASL, etc.), including obtaining appropriate consent from the recipients of your campaigns. You are responsible for the accuracy of the data you connect and for keeping the API keys you provide secure. You agree not to use TextLaunched to send unlawful, harassing, deceptive, or spam content.

We may suspend or terminate accounts that send spam, that send content prohibited by carriers (illegal goods, certain adult content, certain financial services), that engage in cold outreach to recipients who have not opted in, or that abuse the service in ways that harm other operators or recipients.

You retain ownership of your data, your customer lists, and the campaigns you create through TextLaunched. We retain ownership of the TextLaunched product, brand, code, and AI systems that power it. AI-generated campaign drafts are provided to you under a non-exclusive license to use in your marketing activities; we do not retain rights to the specific drafts you ship.

We aim for 99.9% uptime but provide the service "as is" with no warranty. Scheduled maintenance windows and emergency incidents may cause downtime. We are not liable for losses caused by service interruptions or by the third-party APIs (Shopify, Klaviyo, Mailchimp, Twilio, Stripe) that TextLaunched depends on.

To the maximum extent permitted by law, TextLaunched is not liable for indirect, incidental, special, or consequential damages, lost profits, or lost data. Our aggregate liability to you for any claim arising from these Terms or the service is limited to the amount you paid us in the twelve months immediately preceding the claim.

You can terminate your account at any time from the dashboard. We may terminate or suspend your account for cause (breach of these Terms, abuse, non-payment) with reasonable notice. After termination, your data is retained for 30 days per the Privacy Policy retention schedule, then deleted.

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Disputes that cannot be resolved informally will be resolved in the state or federal courts of Orange County, California.

We may update these Terms as the product evolves. Material changes will be communicated to active operators via email at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance.
